There are two major exceptions or exemptions for when you file W-2 forms. Do not file a Form W-2 for independent contractors who you do not employ at your business. Misclassifying non-salaried workers creates problems for your business and the contractor. Another Form W-2 filing exemption is if you send the form to an employee and you get a bounce-back. Do not forward undeliverable forms to the Social Security Administration. Keep these types of forms in your records for at least four years.
